Jo Ellen Livingston, Ph.D. Jo Ellen Livingston, Ph.D has been providing consulting services to litigators on all aspects of the trial process since 1990. She consults in a variety of litigation areas including intellectual property, environmental, employment, antitrust/securities, medical malpractice and personal injury matters. However, her primary focus is working with defense counsel on mass product liability litigation. She has worked with the nation’s largest corporations in automotive, financial, pharmaceutical, medical, petrochemical, computer, biotechnology and insurance industries. Recently, Dr. Livingston has been an influential member of Kaye Scholer’s trial team in their defense of Novartis Consumer Health in phenylpropanolamine (PPA) product liability cases across the country. As part of this team, she conducted research with over 4,000 jury eligible participants, crafted effective trial themes, drafted voir dire questions, participated in jury selection, and played an influential role in shaping opening statements and closing arguments. Due to their tremendous success trying the PPA cases, The American Lawyer recently named Kaye Scholer as the product liability lawyers of the year. Dr. Livingston’s primary focus is working with defense counsel on mass product liability litigation. In addition to her practice work, Dr. Livingston has extensive experience speaking with legal associations and conducting in-house seminars at law firms around the country. Dr. Livingston earned a doctorate in Industrial/Organizational Psychology from Tulane University in New Orleans. Prior to joining ZMF, she was Vice President and Director of Trial Consulting at Frederick Schneiders Research in Washington, D.C. She was also a principle in the litigation consulting firm of Green & Livingston in New Orleans and has worked as a jury research consultant with the firms of Bain, Freibaum, Sagona & Company and Deloitte & Touche.
