Elizabeth Foley Elizabeth Foley is a founding partner in the litigation and communication consulting firm of Zagnoli McEvoy Foley LLC. She has more than 15 years experience in trial consulting and 20 years in teaching communication persuasion skills. She conducts jury research in a variety of case types including environmental & toxic torts, product liability, personal injury and commercial litigation.
Foley applies her empirical and experiential knowledge to assist attorneys with venue analysis, focus groups/mock trials, voir dire and jury selection, witness preparation and the effective composition and delivery of opening statements and closing arguments. Over the years, she has assisted attorneys in hundreds of cases in venues all over the country.

She is frequently called upon to speak at Fortune 500 corporations, major law firms, state bar associations, trial lawyer conferences and the American Society of Trial Consultants (ASTC).
She has published articles on case themes, jury decision making and persuasion. Her article, “The Changing Faces of Juries: Understanding Generation X” was on the forefront of this research trend. Her most recently published article, “The Fine Art of Apologizing: Saying You’re Sorry Changes the Dynamics of Litigation” is also on the forefront of a new trend in litigation strategy.
