Arbitration Services / Exercises

Preparation. Strategy. Persuasion. They are essential parts of any litigation plan. But they aren't just for the courtroom. Tactics used before a judge and jury can be equally indispensable in arbitration proceedings. Arbitrators aren't jurors, but they still bring to the table their own biases, perceptions and decision-making processes. Taking an active, calculated approach to arbitration helps ensure you make your best case when it matters most.

Online Mock Arbitration Services
With Online Mock Arbitration, you can test the strengths and weaknesses of your arguments, measure the educational value of your visuals and gauge an arbitrator's familiarity with key issues — all before arbitration begins. Via our online survey tool, zOpinion, select arbitrators will provide insight to their reasoning, flexibility in seeing an argument from multiple points of view and his or her perspective on the relative importance attached to the major issues in your case. A faster and cost-effective alternative to the full scale mock discussed below.

Mock Arbitration Services
At ZMF, we have learned that there isn't one “right” way to present an argument. Each panel member finds different arguments, examples and evidence to be the most persuasive part of a presentation. Through the course of a mock arbitration, you gain insight into the arbitration process and how actual arbitrators will perceive your case. Previous mock arbitration exercises have provided us with invaluable information as to how neutrals use their own litigation experience, interpret the arguments and evaluate a lawyer's presentation.

When asked how the arguments could be better, arbitrators in the past have made comments such as:

“More examples of objections from [witnesses].”

“Add structure to it. While it was there, may be good to put on a [visual].”

“Having been a defense attorney, all of my previous objections have been overcome.”

ZMF puts together a mock arbitration that improves your presentation’s content and style.
